You will require pool compliance certificate to verify that a swimming pool meets certain safety requirements (e.g. child resistant barriers around the pool) before the property can be rented or if it is sold. This also applies to Swimming pools include any excavation, structure or vessel that can be filled with water to a depth greater than 30 centimeters (including spa pools, but not spa baths).
Pool Compliance Register:
These safety requirements apply to all swimming pools that exist, or are to be built, on residential property or property that is used for visitor or tourist accommodation. Please note that a new registration scheme has been implemented and all pools will now need to be registered on the NSW pool register.

What types of pools are required to have a pool certificate of compliance?
‘Swimming pools and spa pools’ includes in ground, above-ground, indoor, portable and other types of pools and spa pools that are capable of being filled to a depth of 300mm or more of water. Bathroom spas that are used as baths and emptied after use are not included.Definition of a Swimming Pool
A swimming pool means an excavation, structure or vessel: (a) that is capable of being filled with water to a depth greater than 300 mm and (b) that is solely or principally used, or that is designed, manufactured or adapted to be solely or principally used, for the purpose of swimming, wading, paddling or any other human aquatic activity, and includes a spa pool, Therefore, in ground, above-ground, indoor, portable and other types of swimming pools and spa pools are included in these new swimming pool safety laws.
What is a pool certificate of compliance?
A swimming pool certificate of compliance certifies that the pool and pool barrier meet the safety requirements.What do Swimming Pool or Spa owners need to do?
The owner of any property on which a swimming pool is located must ensure that it is registered and meets the relevant safety requirements. From the 29th April 2016, all properties with a swimming pool or spa pool that are sold must have a valid swimming pool certificate of compliance. Before being able to sell or lease a property that includes a swimming pool owners will need to have the pool inspected and have received a certificate of compliance.
How long does a certificate of compliance remain valid?
There will also be mandatory inspections (at least once every 3 years) of swimming pools on any properties that have more than 2 dwellings or are used for tourist or visitor accommodation. Swimming pools that meet the relevant safety requirements will be issued a certificate of compliance.There is a penalty for owners who fail to register a pool or gain a certificate of compliance?
Pool owners will require a compliance certificate before sale or lease of their property from 29 April 2014 onwards. A pool owner can face penalties of up to $5,500 for non-compliance with the pool safety requirements and on-the-spot fines of $550.
